Understanding Malta's Merit-Based Citizenship: A Guide for U.S. Nationals

Malta's legal framework for citizenship by naturalisation on the basis of merit represents one of the more clearly defined pathways to Maltese nationality available to foreign nationals today. Originally introduced in 2017 and significantly refined through Act No. XXI of 2025 and its implementing regulations under Legal Notice 159 of 2025, this route is grounded in Article 10(9) of the Maltese Citizenship Act (Chapter 188 of the Laws of Malta) and is administered by the Community Malta Agency.

For U.S. nationals, the framework is particularly relevant given that the United States generally permits dual citizenship meaning an American who acquires Maltese citizenship is not required to renounce their U.S. nationality.  In addition, it is worthwhile noting that Malta is the only English-speaking country in Europe making a potential relocation fairly straightforward.

The Legal Basis

Article 10(9) of the Maltese Citizenship Act grants the Minister responsible for citizenship authority to confer naturalisation upon individuals who have rendered, or are capable of rendering, exceptional services or contributions to the Republic of Malta or to humanity at large, or whose naturalisation is deemed to be of exceptional interest to the Republic of Malta.

"The Minister may grant a certificate of naturalisation as a citizen of Malta to any person who renders or has rendered exceptional service to the Republic of Malta or to humanity, or whose naturalisation is considered to be of exceptional interest to the Republic of Malta."

The current merit-based framework deliberately excludes any transactional or investment-based elements, emphasising instead demonstrated achievement, contribution, and genuine ties to Malta.

The detailed procedural and eligibility criteria are governed by the Granting of Citizenship by Naturalisation on the Basis of Merit Regulations, codified under Subsidiary Legislation 188.06 and Legal Notice 159 of 2025.

Who May Be Eligible

The Regulations identify a wide range of fields in which applicants may be considered, provided their profile demonstrates manifestly superior or exceptional value to Malta or to humanity. Recognised categories include, but are not limited to, science and research, technology and innovation, entrepreneurship, sport, the arts and cultural industries, philanthropy, and areas aligned with Malta's broader strategic priorities.

It is worth noting that the threshold for eligibility is not defined by celebrity status or global fame. The framework does not require an applicant to hold world records or international renown. What the law calls for is a demonstrable and genuine contribution — one that adds meaningful value to Malta or to humanity in the applicant's field. An individual who has built a business of substance, who has supported causes of public benefit, or who has the profile and the means to develop or contribute to a project aligned with Malta's interests, may have a legitimate basis from which to explore this pathway.

In practical terms, what the authorities assess is the coherence and credibility of the applicant's overall profile — their background, their track record, and the plausibility and substance of their proposed contribution to Malta. A well-structured and documented proposal that demonstrates genuine alignment with Malta's social, economic, or cultural priorities carries weight in the evaluation process.

To summarise, applicants are generally expected to satisfy one or more of the following criteria:

  • Have rendered or will render exceptional services to Malta or to humanity through distinguished accomplishments, leadership, or impact in their respective field
  • Have made or will pledge to make a significant contribution to Malta, including through entrepreneurship, innovation, philanthropy, investment, cultural enrichment, or initiatives that create employment and economic value

Citizenship by merit may be considered for individuals operating in sectors such as:

  • Entrepreneurship, business leadership, and investment
  • Philanthropy and social impact initiatives
  • Technology, digital innovation, and artificial intelligence
  • Science, medicine, and academic research
  • Arts, culture, film, and creative industries
  • Other strategic sectors where exceptional talent or contribution is deemed beneficial to Malta

The Application Process

The merit-based citizenship process is structured and sequential. Each stage is a prerequisite for the next, and the overall pathway requires a genuine period of legal presence and integration in Malta before a citizenship application may be submitted.

The process begins with a residence application. Before any merit-related submissions can take place, the applicant must establish lawful residence in Malta and obtain a valid residence card. This step is foundational: without confirmed legal residence, the subsequent stages of the process cannot proceed.

Once a residence card has been issued, two parallel processes may be initiated. The applicant submits a merit proposal letter to the Community Malta Agency — a detailed document outlining their background, achievements, the nature of their proposed contribution to Malta, and a clear plan for ongoing engagement with the country. At the same stage, a formal due diligence application is submitted, initiating a robust background review of the applicant to confirm integrity and the absence of any disqualifying factors.

An independent Evaluation Board then assesses the merit proposal and issues a recommendation to the Minister responsible for citizenship. The Minister evaluates that recommendation and takes a decision.

The law requires that applicants demonstrate a minimum of eight months of lawful residence in Malta before a citizenship application may be formally submitted. Once this residence requirement has been satisfied and the merit and due diligence processes have reached a favourable conclusion, the citizenship application may be lodged. Upon final approval by the Minister, the applicant and any approved dependants take the Oath of Allegiance and are issued a certificate of naturalisation.

Dependants and Family Members

The legal framework permits the inclusion of certain family members in a successful application. A spouse or partner and unmarried dependent children up to the age of 28 may be included, subject to the eligibility requirements established under the Regulations.

Relevance for U.S. Nationals

American nationals considering this pathway should note several practical factors. For Americans, Maltese citizenship carries a set of practical implications that are worth understanding clearly. As a member state of the European Union, Malta confers upon its citizens the right to reside, work, study, and retire freely across Europe. This means a Maltese citizen may establish themselves in any of the 27 member states without the need for a work permit or separate residency application — a degree of geographic and professional flexibility that is not available to U.S. nationals holding only an American passport. When holding a US passport, one can travel to Europe without a visa but only for short stays of 90 days, while with a Maltese citizenship, one achieves the right to establish themselves in Europe.

Beyond Europe, a Maltese passport carries significant international reach, with visa-free or visa-on-arrival access to over 180 countries. For Americans who travel extensively for business or personal reasons, this can represent a meaningful practical advantage, particularly in jurisdictions where U.S. passport holders face additional entry requirements.

Malta itself merits consideration as a place of residence and connection. It is a small, stable, English-speaking country — English is one of Malta's two official languages — which makes the process of integration considerably more straightforward for American nationals than it might be elsewhere in Europe. Malta maintains a broadly neutral international posture and has a well-functioning economy with a developed services sector, a favourable tax framework for certain categories of resident, and a high standard of living by regional standards. The country is geographically well-positioned, with direct flight connections to major European cities and beyond.

These characteristics do not diminish the seriousness of the citizenship process itself, which is governed by strict legal criteria and genuine evaluation. They do, however, provide context for understanding why Maltese citizenship holds particular relevance for American nationals exploring a connection to Europe.
